Organization: Dubai Offroaders / Al Turuq Al Waera Desert Driving Institute LLC

Website: www.dubaioffroaders.com

1. PURPOSE AND SCOPE

Dubai Offroaders organizes and facilitates off-road driving, desert exploration, wadi driving, vehicle recovery, driving training, expeditions, camping, overnight trips and other recreational or automotive activities in the United Arab Emirates.

These activities may take place in remote, uneven, sandy, rocky, mountainous or otherwise challenging terrain and may involve risks that cannot be completely eliminated, even when reasonable precautions are taken.

This document establishes the conditions of participation, safety responsibilities, environmental obligations and acknowledgment of risks applicable to members and other participants.

By signing this document, the undersigned acknowledges that they have read, understood and agreed to comply with its terms, together with all applicable event-specific instructions, safety briefings, registration requirements and participation conditions.

This disclaimer applies to activities organized by Dubai Offroaders and, where expressly applicable, activities conducted in collaboration with event organizers, sponsors, landowners, venues, service providers or other third parties.

2. VOLUNTARY PARTICIPATION AND ELIGIBILITY

2.1. Participation in any drive, expedition, training session, recovery operation, camping trip or related activity is voluntary and undertaken at the participant's own discretion.

2.2. Membership of Dubai Offroaders does not guarantee admission to every activity. Participation may be restricted according to vehicle suitability, driver capability, experience, fitness, available space, route difficulty, weather conditions, operational requirements or safety considerations.

2.3. Dubai Offroaders reserves the right to refuse, suspend, restrict or terminate participation where a person's conduct, vehicle condition, equipment, driving ability or circumstances are considered unsuitable or unsafe.

2.4. Participants must comply with applicable UAE laws, traffic regulations, access restrictions, permit conditions and lawful instructions issued by the relevant authorities.

2.5. Participants must provide accurate registration details and disclose any information reasonably necessary to assess their eligibility and safety for a particular activity.

3. ACKNOWLEDGMENT AND ASSUMPTION OF RISK

3.1. I understand that off-road driving and associated outdoor activities involve inherent and potentially serious risks, including, but not limited to:

  • Vehicle rollover, collision, loss of control, mechanical failure or immobilization.
  • Getting stuck in soft sand, steep dunes, deep ruts, mud, loose gravel or rocky terrain.
  • Hidden obstacles, sudden changes in terrain, steep slopes, sharp rocks, uneven surfaces and poor visibility.
  • Falling, vehicle recovery incidents, winch or recovery equipment failure, and injuries caused by recovery straps, ropes, shackles or other equipment.
  • Extreme heat, dehydration, sun exposure, dust, sandstorms, reduced visibility, rain, flash floods and rapidly changing weather conditions.
  • Remote locations, delayed emergency assistance, limited communications and difficult evacuation.
  • Encounters with wildlife, insects, snakes or other animals.
  • Injuries to drivers, passengers, marshals, spectators or other persons.
  • Damage to vehicles, personal property, camping equipment or third-party property.
  • Serious bodily injury, permanent disability or death.

3.2. I understand that these risks may arise from terrain conditions, environmental factors, equipment failure, the conduct of other participants, my own actions or other circumstances beyond my control.

3.3. I voluntarily accept the inherent risks of participating in these activities, including risks that may be foreseeable or unforeseen, to the extent permitted by applicable law.

3.4. I acknowledge that the presence of experienced drivers, trained marshals, communication equipment, tracking systems, recovery vehicles or emergency arrangements does not eliminate all risks or guarantee that accidents will be prevented.

3.5. I understand that Dubai Offroaders cannot guarantee the safety of every route, the mechanical reliability of any vehicle, uninterrupted communications, immediate recovery or the availability of emergency assistance at all times.

4. DRIVER RESPONSIBILITIES

Every driver participating in a Dubai Offroaders activity agrees to:

4.1. Hold a valid driving licence appropriate for the vehicle being driven and comply with all applicable legal requirements.

4.2. Drive only when physically and mentally fit, adequately rested and capable of safely controlling the vehicle.

4.3. Never drive under the influence of alcohol, illegal drugs, impairing substances or medication that makes driving unsafe.

4.4. Wear a seat belt at all times and ensure that all occupants use appropriate seat belts or legally required child restraints.

4.5. Drive within their ability and experience, maintain a safe distance from other vehicles, control their speed and avoid unnecessary risks.

4.6. Never attempt a dune, slope, wadi crossing, obstacle or recovery manoeuvre beyond their capability or contrary to instructions from the lead marshal or designated safety personnel.

4.7. Never overtake, leave the convoy, change the designated route or undertake a separate driving activity without authorization where convoy or route-control procedures apply.

4.8. Stop or withdraw from an activity if the vehicle becomes unsafe, the driver feels incapable of continuing or conditions deteriorate.

4.9. Immediately report accidents, injuries, mechanical problems, damage, dangerous conditions and safety concerns to the designated marshal or event coordinator.

4.10. Remain responsible for their own driving decisions and the safe operation of their vehicle, notwithstanding the presence of marshals or other experienced participants.

5. VEHICLE ROADWORTHINESS AND PREPARATION

5.1. Each driver is responsible for ensuring that their vehicle is legally compliant, roadworthy, mechanically sound and suitable for the intended terrain and activity.

5.2. Participants must ensure that their vehicles have suitable tyres, brakes, steering, suspension, cooling systems, recovery points and other equipment appropriate to the drive.

5.3. Required or recommended equipment may include a suitable recovery kit, tyre-pressure gauge, tyre-inflation equipment, first-aid supplies, sufficient drinking water, a charged mobile phone, communication equipment and an approved tracking device or application where specified.

5.4. Participants must follow the event briefing regarding tyre pressures, vehicle preparation, fuel, equipment and other operational requirements.

5.5. Participants must disclose any significant vehicle limitation that could affect their safety or the safety of the convoy.

5.6. Dubai Offroaders may inspect a vehicle visually or request that the driver demonstrate the presence of specified equipment. Such an inspection is not a mechanical certification, warranty or guarantee of roadworthiness.

5.7. The driver remains responsible for any vehicle defects, modifications, equipment failures or maintenance deficiencies.

5.8. Dubai Offroaders may exclude a vehicle from an activity if its condition, configuration or capabilities are considered unsuitable for the planned route.

6. MARSHAL AUTHORITY AND CONVOY DISCIPLINE

6.1. Marshals are appointed to coordinate the activity, communicate safety instructions, monitor the convoy, assist participants and coordinate recovery or emergency responses within the scope of their assigned roles.

6.2. Participants must follow reasonable and lawful instructions from the lead marshal, designated convoy marshals, event safety personnel and authorized recovery personnel.

6.3. Marshals are not personal driving instructors or guarantors of individual driving decisions. Their presence does not transfer responsibility for the safe operation of a participant's vehicle from the driver to the marshal.

6.4. Participants must not disregard instructions, pressure marshals to permit unsafe manoeuvres, obstruct communications or interfere with event operations.

6.5. Participants must not undertake unauthorized recovery operations, attempt to recover another vehicle without appropriate competence and equipment, or enter a recovery zone without permission.

6.6. If a vehicle becomes immobilized, the driver must follow marshal instructions, secure the vehicle as safely as possible and avoid actions that could endanger occupants, recovery personnel or other vehicles.

6.7. Participants must remain with the convoy or at their assigned location unless instructed otherwise. If separated, they must follow the event's lost-convoy or emergency communication procedure rather than attempting an unfamiliar route independently.

6.8. Dubai Offroaders may stop, modify, reroute, postpone or cancel an activity if conditions or participant behaviour present unacceptable risks.

6.9. A participant who refuses to follow safety instructions may be removed from the activity and may be subject to further membership action.

7. VEHICLE RECOVERY AND ASSISTANCE

7.1. Recovery operations may involve towing, winching, pulling, lifting or repositioning vehicles in unstable or hazardous terrain.

7.2. Recovery assistance is provided subject to personnel availability, equipment suitability, terrain, weather and safety considerations. No guarantee is given that a vehicle can be recovered immediately or without damage.

7.3. Participants must follow instructions concerning safe distances, recovery points, exclusion zones, equipment handling and the positioning of vehicles and bystanders.

7.4. No participant may stand near a tensioned recovery strap, rope, winch line or other loaded recovery equipment, or otherwise enter a designated recovery exclusion zone.

7.5. Vehicle owners and drivers remain responsible for their vehicles, including pre-existing defects and damage sustained during recovery, subject to applicable law and any separate written agreement.

7.6. Recovery costs, specialist assistance, towing, transport, repairs or other expenses may be payable by the vehicle owner or participant where applicable and where the relevant terms have been communicated.

7.7. Dubai Offroaders may decline or discontinue a recovery manoeuvre that is considered unsafe. Participants must not pressure recovery personnel to proceed against their safety judgment.

8. PASSENGERS, GUESTS AND MINORS

8.1. Drivers are responsible for ensuring that their passengers are informed of the nature of the activity, its risks, the applicable safety rules and the need to comply with marshal instructions.

8.2. Drivers must not carry more occupants than the vehicle is legally and safely designed to accommodate.

8.3. Passengers must use appropriate seat belts or legally required restraints, remain seated while the vehicle is moving and follow the driver's and marshals' safety instructions.

8.4. Passengers must not distract the driver, interfere with vehicle controls, exit the vehicle in unsafe conditions or engage in behaviour that creates a risk to themselves or others.

8.5. Children may participate only where the specific activity permits them and appropriate supervision, seating and restraint arrangements are in place.

8.6. A parent or legally authorized guardian must provide any consent required for a minor's participation and acknowledge the risks on the minor's behalf, subject to applicable law.

8.7. A parent or guardian remains responsible for supervising their child and ensuring that the child follows the event rules.

8.8. A minor's participation is not permitted where required consent, appropriate supervision or suitable safety arrangements are absent.

8.9. This document does not purport to waive or remove any rights that cannot lawfully be waived on behalf of a minor.

9. CAMPING, OVERNIGHT STAYS AND OUTDOOR ACTIVITIES

9.1. Participants in camping and overnight activities are responsible for their personal belongings, camping equipment, food, drinking water, clothing, lighting and other individual requirements.

9.2. Participants must take reasonable precautions against heat, cold, dehydration, insects, wildlife, fire, uneven terrain and other environmental hazards.

9.3. Campfires, cooking equipment, generators, lights and other potentially hazardous equipment may be used only where lawful, permitted and operated safely.

9.4. Participants must not leave unattended flames, improperly stored fuel, exposed electrical equipment or other hazards at the campsite.

9.5. Participants must secure their vehicles, equipment and tents appropriately and follow instructions regarding campsite layout, parking and emergency access.

9.6. Dubai Offroaders does not guarantee the security of personal property or the suitability of every campsite for every individual.

9.7. Participants are responsible for their own comfort and personal requirements and must inform the organizers of any assistance reasonably needed for safe participation.

10. ENVIRONMENTAL PROTECTION AND WILDLIFE

10.1. Dubai Offroaders is committed to responsible off-roading and expects all participants to respect the UAE's desert, wadis, protected areas, natural habitats and wildlife.

10.2. Participants must remain on the designated route and must not enter restricted, protected or environmentally sensitive areas without lawful authorization.

10.3. Participants must not chase, harass, approach, feed, capture, injure or deliberately disturb wildlife, including camels, gazelles, reptiles, birds and other animals.

10.4. Participants must maintain a safe distance from animals and avoid unnecessary noise, sudden movements, excessive lighting or driving manoeuvres that may frighten or injure them.

10.5. If wildlife is encountered on or near the route, drivers must reduce speed, maintain control, give animals adequate space and follow marshal instructions. The convoy must not deliberately pursue or surround animals.

10.6. Participants must not litter, dump waste, discharge vehicle fluids, abandon equipment or leave food waste in the desert.

10.7. All rubbish must be collected and taken away for appropriate disposal. Campsites and rest stops must be left clean.

10.8. Participants must avoid unnecessary engine revving, excessive noise, reckless driving and other conduct that disturbs nearby residents, other visitors or wildlife.

10.9. Participants must not damage vegetation, excavate terrain, disturb animal habitats, damage archaeological or heritage features or engage in unauthorized fires.

10.10. Any accidental damage to the environment, wildlife injury, fuel spill or other environmental incident must be reported to the marshal as soon as reasonably practicable.

10.11. Participants must comply with applicable environmental laws, wildlife protection requirements, access restrictions and instructions issued by relevant authorities.

10.12. A breach of this section may result in immediate removal from an activity and further membership action, without prejudice to any liability under applicable law.

11. MEDICAL FITNESS, INJURY AND EMERGENCIES

11.1. Participants are responsible for assessing their fitness to take part and should seek appropriate medical advice if uncertain about their ability to participate safely.

11.2. Participants should carry necessary personal medication and advise the designated organizer of any information essential to responding safely to a foreseeable emergency, to the extent appropriate and lawful.

11.3. Participants acknowledge that outdoor activities may involve delayed access to medical facilities, limited mobile coverage and evacuation difficulties.

11.4. In an emergency, participants must follow reasonable safety instructions and cooperate with emergency responders and event personnel.

11.5. Dubai Offroaders may request emergency medical assistance where reasonably necessary. Participants acknowledge that emergency assistance may involve costs, and responsibility for those costs will be determined under applicable law, insurance arrangements and any relevant service terms.

11.6. Dubai Offroaders does not provide a guarantee of medical treatment, emergency evacuation or rescue within a specified time.

11.7. Nothing in this document prevents a participant from seeking medical assistance or exercising any legal right relating to personal injury.

12. INSURANCE AND PERSONAL PROPERTY

12.1. Each vehicle owner or driver is responsible for maintaining legally required motor insurance and ensuring that the policy is appropriate for the intended activity and vehicle use.

12.2. Participants should verify whether their insurance covers off-road driving, desert use, recovery, vehicle damage, passenger injury, third-party liability and other relevant risks.

12.3. Participants are encouraged to obtain appropriate personal accident, medical, travel or other insurance where suitable for the activity.

12.4. Participants are responsible for their own vehicles, phones, cameras, valuables, camping equipment and other personal property, subject to any rights or remedies available under applicable law.

12.5. Dubai Offroaders does not represent that a participant's existing insurance provides adequate coverage.

12.6. Participants should contact their insurers directly to clarify coverage, exclusions, deductibles and claims procedures.

13. LIABILITY, WAIVER AND RELEASE

13.1. I acknowledge that participation involves risks and that I am responsible for my own actions, decisions, vehicle operation and compliance with safety instructions.

13.2. To the extent permitted by applicable law, I agree that Dubai Offroaders, Al Turuq Al Waera Desert Driving Institute LLC, and their respective authorized representatives, organizers, employees, volunteers and marshals are not responsible for loss, damage, injury or expense arising solely from the inherent risks of voluntary participation, or from my own negligence, unlawful conduct, failure to follow instructions or breach of this document.

13.3. To the extent permitted by applicable law, I release the persons and entities identified above from claims arising from risks that I have voluntarily accepted, except where such release is prohibited by law.

13.4. Nothing in this document excludes, restricts or purports to waive liability to the extent that such liability cannot lawfully be excluded or waived, including any applicable liability arising from fraud, wilful misconduct, gross negligence or other conduct for which exclusion is not legally permitted.

13.5. Nothing in this document removes any non-waivable statutory rights or remedies available to a participant, passenger, minor or other person under applicable UAE law.

13.6. Participants remain responsible for damage, injury, loss or expense caused by their own unlawful acts, negligence, misconduct, breach of safety requirements or damage to third-party property, subject to applicable law.

13.7. The purpose of this section is to record the participant's informed acceptance of inherent risks and to define responsibilities within the limits permitted by applicable law. It is not intended to provide blanket immunity for every act or omission by any person or organization.

14. INDEMNITY AND THIRD-PARTY CLAIMS

14.1. To the extent permitted by applicable law, I agree to be responsible for and, where legally recoverable, indemnify the relevant affected party against reasonable losses, liabilities, damages and costs arising from third-party claims caused by my unlawful conduct, negligence, deliberate misconduct or material breach of this document.

14.2. This provision does not apply to the extent that a claim results from the negligence, wilful misconduct or other conduct of the party seeking indemnification, where recovery is prohibited by applicable law.

14.3. Nothing in this section requires a participant to indemnify another person for liability that cannot lawfully be transferred to the participant.

15. MEMBERSHIP, DISCIPLINE AND REMOVAL

15.1. Membership of Dubai Offroaders is conditional upon compliance with its safety requirements, membership policies and reasonable instructions issued by authorized representatives.

15.5. Membership fees, event fees and other payments will be handled in accordance with the published terms applicable to the relevant membership or activity. This disclaimer does not itself establish a blanket forfeiture or refund policy.

16. PHOTOGRAPHY, VIDEO AND PUBLICITY

16.1. Participants acknowledge that photographs, videos and other recordings may be taken during activities for safety, documentation, training, event reporting or promotional purposes.

16.2. Where a participant's identifiable image or personal information is intended to be used for publicity, publication or other purposes requiring consent under applicable law, the necessary consent will be obtained separately or through an appropriate clearly explained consent mechanism.

16.3. Participants must respect the privacy of other members and must not publish another person's personal information, private communications or identifiable images in circumstances that violate applicable law or the person's lawful privacy rights.

18.4. This document does not replace any additional disclaimer or consent form required for a particular event. Where multiple documents apply, their legal effect and any inconsistency will be determined in accordance with the applicable terms and law.

18.5. Participation in an event does not imply that Dubai Offroaders controls every aspect of the venue, the conduct of third-party participants or the services supplied by independent providers.

19. ROUTE CHANGES, WEATHER AND CANCELLATION

19.1. Routes, meeting points, timings, convoy arrangements and activity plans may change because of weather, terrain, access restrictions, wildlife, safety concerns, mechanical problems, permits or other operational requirements.
